1. Definitions
“we”, “us”, “our” and “supplier” are references to FOOD FOUNDRY, a brand of MUNCHY CONCEPT COMPANY LIMITED; licensed Food Factory at UNIT 402, 4/F, SUN HING INDUSTRIAL BUILDING, 46 WONG CHUK HANG ROAD, WONG CHUK HANG, HONG KONG.
2. Quotation and Event Description
2.1 This Quotation is for the supply of catering services from us to the client, specifically for the above-mentioned event details.
2.2 The client shall provide accurate and timely information regarding the event, including number of guests, dietary restrictions, and other relevant details.
3. Supplier Obligations
Munchy Concept Company Limited reserves the right to: 3.1 change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Munchy Concept Company Limited shall not be liable to you for any such change or removal. 3.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.
4. Client Obligations
4.1 The client is required to provide sufficient support to supply electricity power, clean water, air-conditioning facilities, clean and objectively sufficient space of venue for food & beverage display and preparation.
4.2 The client is also liable to any loss or damage of any reusable item, material, utensil, equipment temporarily provided by the supplier. In the event of loss or damage of occurred, the client may be claimed.
4.3 The client shall cooperate with Food Foundry and provide reasonable assistance to enable the smooth execution of the catering services.
5. Provision of Food & Beverage
5.1 All food and Beverage are prepared at our licensed kitchen, then delivered and served at the event venue.
5.2 All food provided by us must be consumed within two hours of initial serving as the “two-hours rule”. We cannot guarantee the quality and safety of any food consumed after this time limit and will not be liable for any ill effects caused by consumption of food that is not provided by Food Foundry . The “two-hours rule” states that perishables exposed at room temperature for more than two hours should be discarded to minimize food poisoning risks.
5.3. Food Foundry do not take any responsibility for any potential food safety issues should not all food and beverage are not fully provided by the us, nor the food being consumed outside the venue or the time of service stated on this proposal.
5.4 We will not be liable for any food or drink allergies of which we have not been notified.
5.5 Should tasting session is included in the proposal, the service would only be provided subject to deposit payment of this quotation being settled.
6. Provision of Manpower
6.1 The provision of Manpower may be subject to change on the day of the event. Minimum of one chef, one server and one service manager is required and provided for any outside catering service. In general, our recommended ratio of server in a catering service is (1:7) one server to seven guests. Event staff are charged at a minimum of 4 hours.
6.2 If staff are required to work more hours than quoted for then an additional charge will be made for this extra time which will be added to the final invoice. Extension service will be charged after 15 minutes over the proposed service time of staff stated in the proposal.
6.3 Additional hour(s) (the OT rate) for over-run event will be charged as per staff as follow, on an hourly basis counting from every first 15 minutes of the overrun hour. A handling fee of $2,500 per event will also be added on top of the OT rate.

6.4 Additional transportation fee will be chargeable if the catering service required to start before 7:00am or finish at or after 00:00mn, an additional transportation fee will be charged as per staff provided, and the charges are as follow:

7.1 The client must notify Food Foundry immediately should the client decided to cancel the catering service. Cancellation must be notified to us initialed by e-mail or written notice to one of our sales representatives. Cancellation will be treated as confirmed only after we have sent out a written or e-mail confirmation of our acceptance to the client.
7.2 In the event of cancellation by the client, a 50% fee will be charged for cancellation made 21days prior to the event, or 100% fee will be changed within 7 days prior to event day, determined by the total quoted price in this proposal.
8. Bad Weather
8.1 Increment weather conditions may impact the provision of outside catering services. In the event of bad weather, Food Foundry reserves the right to make reasonable adjustments to the catering services to ensure the safety of guests, staff and the successful execution of the event.
8.2 In the event of typhoon signal 8 (and above), black rainstorm or extreme weather condition that is officially announced by the HKGOV, the client is eligible to propose an alternative day for the service within ONE month of the original service date of this proposal, subject to availability of Food Foundry. Any additional costs incurred as a result of the adjustment shall be the responsibility of the client.
8.3 No refund will be arranged for event cancellation due to bad weather.
9. Payment
9.1 The Client agrees to pay Food Foundry the agreed-upon fees for the catering services, as specified in the agreement.
9.2 An invoice for 80% non-refundable deposit is required to be settled within 7 days after acceptance of this proposal to secure the booking .
9.3 A final payment invoice will be issued upon completion of the catering service, any additional charges incurred will also be added and specified onto the final payment invoice.
9.4 Food Foundry reserves the right to charge interest on any overdue final payments.
